Good fences



The flag of ExCathedra's fantasied post-American republic --the lower one-- is bounded by a red border. The color of blood.

Which would be spilled when aliens crossed without permission. 

What is the point of a border --or a fence around your property, or a door to your home-- if strangers can just waltz through it and not be repulsed with force? As much as required.

In the new Republic's constitution, by way of specific exception, due process assumption of innocence would not extend to illegal invasion. Such persons who entered, without having been killed by the border guards after the required warning shots, would be presumed guilty and have 48 hours to prove otherwise.

Failure to provide compelling evidence would lead to immediate expulsion. On a second offence, there'd be a session of corporal punishment and a year in a nasty labor camp, followed by expulsion. On a third offence, summary execution.

Any citizens or legal residents aiding such persons would have normal due process, but their punishment, if found guilty, would be the same as for a foreigner's second offence and then third.
